Denmark - Transposition of the EU Directive on Whistleblowing

The Ministry of Justice in Denmark has announced that public consultation on a draft law to protect whistleblowers has opened as of 24 February 2021. Comments on a draft proposal are being invited from a list of stakeholder organisations until Wednesday 24 March 2021.

It has been reported that in Denmark the government has in communications to it’s political parties, demonstrated an intention to expand the scope, including to reports of sexual harassment in the workplace.
A draft Bill to implement the Directive on Whistleblowing is expected to be sent for public consultation in the next few weeks and then tabled to be discussed in March 2021 during the current parliamentary session. This would mean the public consultation will likely only be open for a few weeks.

In the autumn of 2019, a number of stakeholders from the employment sectors participated in a meeting in the Danish Ministry of Justice concerning the implementation of the directive. On 17 June 2020, the Danish National Organisation of Municipalities informed WIN that they have not heard more about the implementation process since the meeting in autumn 2019. There have been taken no centrally organised steps concerning implementation with regard to the municipal sector. A few municipalities in Denmark already have a whistleblower mechanism of their own and some are considering putting one in place.
